These terms apply to all work carried out by Premier Lawns Limited (“Premier Lawns”, “we”, “us”). By approving a quote you agree to them.

Quotes and pricing

A quote is valid for 30 days. After that, prices may change.

Quotes are based on the details you give us. If the lawn turns out to be a different size or in a different condition when we visit, we will tell you about any change in price before work starts.

All work is discussed and agreed before the start date, and will be carried out by Premier Lawns unless otherwise agreed.

The price quoted includes all labour and materials.

Any additions or changes to the agreed work are treated as variations. They must be agreed in writing and may cost extra.

Green waste and your brown bin

We use your brown bin first, so please make sure we can get to it on the day we visit.

There has been a change in the council sites we can use, and getting rid of green waste is now a lot more difficult.

Where your quote includes green waste removal, we take away what does not fit in the brown bin. If the bin is full or we cannot get to it, we reserve the right to charge for the extra.

Where your quote does not include green waste removal, any waste we take away is charged as an extra.

“Waste removal” means only waste produced by our own work.

VAT

Premier Lawns is not currently registered for VAT. If that changes, we reserve the right to requote for any future work. You will be told in writing before it happens.

Access to your property

You agree to give us access to the site during our normal working hours, Monday to Friday, 8am to 5.30pm.

Severe weather, including drought, may delay visits. This will not affect the agreed price.

Dog mess

Dog mess is a health risk to our staff. Please make sure the lawn is clear of it before every visit.

If there is dog mess on the lawn we may not be able to carry out the work. If the visit was pre-arranged, we may still charge a call-out fee to cover costs such as insurance, fuel and wear and tear on equipment. The amount is set out in the terms on your quote.

Your responsibilities

Please clear any litter from the lawn before we visit.

We take every care around pebbled and landscaped areas, but you are responsible for making sure there are no stones or other items in the lawn. We cannot be held responsible for damage caused by small stones and other items left in the lawn.

Missed appointments and cancelled visits

We are a small business. When we turn up and cannot get on to the lawn, there is a cost to us in the wasted visit and in having to come back.

If we cannot get access on the date of a scheduled visit, or you give us less than two days’ notice, we reserve the right to charge for the visit in full.

If it happens repeatedly, we may end the service straight away.

Treatments and spraying

Spraying is carried out by fully qualified NPTC operators and in line with all statutory requirements. We will spray when programmed, weather permitting. Any treatment is only applied in suitable weather conditions.

Aeration and underground services

Aeration and scarifying go below the surface of the lawn. Before we visit, please tell us in writing about anything buried in or under the lawn, such as robot mower wires, irrigation pipes, cables and drains.

We cannot be held liable for damage to, or costs involved with, underground hazards, obstructions or services that we were not told about in writing.

Grass cutting and hedge cutting

This section applies only where grass cutting or hedge cutting is part of your agreed service.

Grass cutting: before we cut, we remove obstacles from the area. We cut the whole grassed area to good industry practice for its intended use. We will not be held responsible for grass clumping in damp weather where clippings are left on site and not collected.

Hedge cutting: the price given is to remove the last six months’ growth. Reduction work is quoted separately. Where possible we cut hedges outside the bird nesting season, March to July inclusive. If we find an occupied nest, work stops and we will tell you. Work starts again as soon as possible after the nest is no longer in use.

Invoices and payment

We send an invoice after each visit. If your service is priced for the year and paid in instalments, payments are due as set out in your quote. You are responsible for all payments to Premier Lawns.

Payment is due within five days of the invoice date. If an invoice is not paid in full by the due date, we may charge interest on the overdue amount at 5% a year above the Bank of England base rate. Interest builds up daily from the due date until the overdue amount is paid, whether before or after judgment, and must be paid together with the overdue amount. An admin fee may also apply.

We prefer online payment. You can pay securely by card straight from your invoice, or by bank transfer. We also accept cash on the day.

Automatic payments: where you have agreed to it, we collect payment automatically through Jobber and Stripe, using the card you have saved. You can ask us to stop this at any time.

Photos and filming

Filming is a big part of what we do. Premier Lawns may photograph and film your lawn and garden, and use those images, and copies or adaptations of them, for training, accurate quoting, resolving disputes and marketing. This includes, but is not limited to, our website, YouTube, our other social media channels and printed material.

We film the lawn, not you. In our videos we do not say where a garden is. On our website we may name the general area. We will never identify you as the owner, or disclose your address or any personal details.

Images are held in line with data protection law (UK GDPR). If you would prefer your property not to be featured, please tell us in writing. See our Privacy Policy for more information.

Your right to cancel

If you agreed to our service online, by email, by phone or at your home, you have a legal right to cancel within 14 days of the day you approved your quote. This is under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You do not need to give a reason.

If you ask us to start work within those 14 days and then cancel, you will need to pay for the work we have carried out up to the point you cancel.

To cancel, use the cancellation form at the end of these terms, or tell us in writing, for example by email or by letter.

Ending the service

Either of us can end the service at any time. There is no notice period. Please tell us in writing.

Commercial customers: the notice period is one calendar month, in writing, unless your contract states otherwise.

You pay for all work carried out up to that date. Any unpaid balance for that work is due straight away, including where you pay in instalments. If you have paid ahead for work we have not done, we will refund it.

Liability

Premier Lawns accepts no responsibility for accidental breakages arising from our work. Any payment or repair we may make is solely at our discretion and is not an admission of fault or liability.

Premier Lawns’ responsibility is limited to these terms and conditions, except for death or personal injury resulting from the negligence of Premier Lawns, its servants or agents. Premier Lawns shall not be liable for any claim for direct or indirect consequential loss, injury or damage made by the customer or any third party arising out of or in connection with any defect in the services, whether or not that defect is caused by the negligence of Premier Lawns, its servants or agents.

Nothing in these terms affects your statutory rights.
